General Terms and Conditions (GTC)

These General Terms and Conditions (GTC) govern the relationship between Swaptune and its customers for the services offered via its platform. By using our services, you accept these conditions in their entirety.

1. Definitions

• Swaptune: The company offering engine tuning and file management services via its platform.
• Customer: Any individual or legal entity using the services offered by Swaptune.
• Credit: Unit of currency used on the Swaptune platform, where 1 credit = 1 modified file.

2. Services on offer

Swaptune offers :

• Modifying files for engine tuning.
• Access to a secure platform for file exchange.

Services are exclusively digital and irrevocable once executed.

3. Prices and payments

• Payments must be made in advance and in full before the service is performed.
• Prices are quoted in euros (€) and are subject to change without notice.
• Credits are added to the customer's account upon receipt of payment and are non-refundable.

For payment by bank transfer, the following information must be used:

• IBAN: BE05 9501 3619 2375
• SWIFT/BIC: CTBKBEBXXXX
• Communication: Order number.

Proof of payment can be sent to accounting@swaptune.eu to speed up processing.

4. No warranty and liability

• Swaptune offers no guarantee on the services provided.
• Customers must ensure that their vehicle is compatible with tuning before making any request.
• Swaptune accepts no responsibility for the vehicles, as we are unable to test them directly.
• Customers are solely responsible for the consequences of any modifications made to their vehicles.

5. Orders and cancellations

• Once an order has been placed and paid for, it cannot be cancelled or modified.
• Unused credits are non-refundable.

6. Confidentiality and security

Swaptune uses encryption systems to guarantee the security of diagnostic data and modified files.

• The tools we use are automatically updated to ensure optimum performance.
• Files are encrypted to protect customer data.

7. Customer obligations

• Provide complete and accurate information when creating their account and placing orders.
• Comply with the terms of these GTC.
• Ensure that all requested modifications comply with local laws and regulations.

8. Intellectual property

All content, tools, software and services offered by Swaptune are protected by intellectual property rights. Any unauthorized reproduction, modification or distribution is strictly prohibited.

9. Force majeure

Swaptune cannot be held responsible for delays or non-performance resulting from force majeure (natural disasters, technical breakdowns, etc.).

10. Disputes and applicable law

• These GTC are governed by Belgian law.
• In the event of a dispute, the parties agree to seek an amicable solution before taking any legal action.
• Failing amicable agreement, the competent courts will be those of Brussels, Belgium.

11. Changes to the GTC

Swaptune reserves the right to modify these GTC at any time. Customers will be informed of any significant changes via the platform or by email.
